April 14, 2020 ALL AGREEMENT STATES INFORMATION REGARDING TEMPORARY EXEMPTION FROM CERTAIN U.S. NUCLEAR REGULATORY COMMISSION MEDICAL USE REGULATIONS (STC-20-031)
Purpose:
To provide information about the U.S. Nuclear Regulatory Commissions (NRC) exemptions for medical use licensees.
Background:
Due to the Coronavirus Disease 2019 (COVID-19) pandemic public health emergency, the NRC has received exemption requests from medical facilities for regulatory relief.
Discussion: This correspondence provides the temporary exemption template letter being used by the NRC staff to grant exemptions for its medical use licensees. Also included is a spreadsheet with specific temporary exemptions that the NRC staff has evaluated and determined would be appropriate given the current public health emergency caused by the COVID-19 pandemic. This spreadsheet provides standardized language to maintain consistency that regulators can use to fill out the template for these specific exemptions. Please note that medical use licensees need to provide a basis as to why they need these exemptions prior to the regulator granting them. The spreadsheet includes examples of safety bases that would be deemed acceptable. The regulations in the spreadsheet are the only ones the staff has evaluated at this time. Please note this spreadsheet will likely be updated with more regulations. The NRC staff will post updates to the spreadsheet with the Questions and Answers Regarding the COVID-19 Pandemic in the password protected Materials Security Toolbox.
