DRAFT CHARTER II:

Working Group Mission:

The joint NRC, Organization of Agreement States (OAS), and Conference of Radiation Control Program Directors, Inc. (CRCPD) Working Group will examine the impact of the increased number of Agreement States and propose potential options for maintaining the infrastructure of supporting regulations, guidance and other program elements needed for the regulation of nuclear materials on a nationwide basis.

The term "national materials program" is undefined. The Working Group should initially discuss and develop a common definition of a National Materials Program.

The following definition will be used: "a plan that describes the required elements and methods for measuring radiation regulatory programs designed to assure harmonious application of consistent regulations and standards to assure an adequate level of safety and environmental protection."

Options proposed for the Commission's consideration will address the following issues:

-- The required elements and scope of activities in a materials regulatory program such as licensing, inspection, enforcement, training, event reporting, emergency response and program support activities. Program support includes, but is not limited to, developing licensing and inspection guidance, developing program policy and guidance, developing standard review plans, providing laboratory support, rulemaking activities, and surveillance of licensed activities.

-- The roles and legal responsibilities of NRC, the Agreement States, the OAS, the CRCPD and other organizations;

-- The need for statutory changes in Federal and State programs for a national materials program.

Other areas that will be addressed include:

-- The assessment process and performance indicators that could be used to measure the performance of a national materials program considering the current Integrated Materials Performance Evaluation Program (IMPEP) process;

-- Mechanisms for program coordination and program evolution;

-- Identify the resource needs required for a national materials program and options for meeting those resource needs at both State and Federal levels.

Working Group Products:

The Working Group will provide the following products for the Commission's consideration:

-- A definition and draft mission statement defining the goals and objectives of a national materials program that is consistent with the NRC Strategic Plan's materials arena goals, measures, and strategies;

-- A number of options for the structure and elements of a national materiels program;

-- In the extent the Working Group is able to address resource needs and the evaluation process, the report would also address other areas.

Coordination and Information Management:

The Working Group will coordinate and share information with affected parties, including the CRCPD's panel on rulemaking activities and structure of the national materials program. Working Group meetings will be open to the public to encourage public comment and information sharing. The Working Group will also provide information to the public through the use of a web site.

Schedule:

The Working Group will complete the project by May 1, 2002. A schedule of activities will be developed as a part of the first Working Group meeting.
