SUMMARY

DISPOSITION REGARDING THE EFFECTS OF GAPS Pursuant to the Board's 10/31/84 Memorandum (Multiple Filings), CASE (Citizens Association for Sound Energy), Intervenor herein, files this, its Fourth Round Answer to Applicants' Reply to CASE's Answer to Applicants' l

Motion for Summary Disposition Regarding the Effects of Gaps.

CASE's pleading is in the form of the attached Affidavit of CASE Witness Mark Walsh, and the four requirements contained in the Board's 10/31/84 Memorandum (Multiple Filings) have been indicated in Mr. Walsh's Affidavit for the convenience of the Board and parties.

Polk Dallas, Texas 75224 214/946-9446 l CASE's primary representative in this portion of the hearings, Mrs. Ellis, was unaware that the Board had ruled on CASE's 11/15/84 Motion for Reconsideration of Board's 10/31/84 Memorandum (Multiple Filings) until Mrs. Ellis requested Judge Bloch to rule on CASE's Motion on 12/11/84; Judge Bloch advised that the Board had ruled during the other (Intimidation) portion of the hearings.

Subsequently, CASE has received a copy of the transcript pages (Tr. 20,454-455

.during the 11/26/84 hearings) where the Board made that ruling; NRC Staff counsel kindly offered to supply CASE with a copy of these pages when he became aware that Mrs. Ellis did not have a copy of the Board's ruling.
