In a letter dated March 23,1492 (lleference (b)], New flampshire Yankee (NHY) submitted License Amendment llequest 91-07, and a request for an exemption f rom specific prosisions of 10 CFrt 50, to propose changes to the Seabrook Station Technical Specifications. Specifically, License Amendment Request 91-07, and the associated exemption request, proposed to change Technical Specification Surveillance itequirement 4.n.1.2.a to maintain the 40 1 10 month testing interval for Type A Containment Integrated Leak Itate Tests, but eliminate the requirement to perforrn three Type Aents in each Ingear senice period.
't h e requested amendment also proposed to decouple escry third Type A Containment integrated Leak Rate Test in a 109 ear service period from the 10-year plant inservice inspection shutdown.
NilY submitted the aforementioned license amendment and exemption requests to climinate the apparent conflict between the Technical Specification requir:ments, which do not differentiate betwcen "preoperational" and ' periodic" Type A tests, and the current T pc 3
A testing schedule. NilY has previously conducted two Type A Containment Integrated I. cal Rate Tests; the first in March 1986, and the second in November 1989 These tests were performed in anticipation of the /cro power and full power operating licenses, respectisely.
Due to the delay in receising the full power operating license, and in order to maintain the 40 1 10 month testing interval, the third Type A test is scheduled to be conducted during the 1992 refueling outage. Since this test will not coincide with the 109 ear plant insenite inspection shutdown, it appeared to oc in conflict with the Technical Specification testing ri. quir ement s described abos e.

Document Control Desk l' age t w o During their review of 1.ieense Amendment Request 91-07, the NRC Staff contacted NilY l Reference (c)l to discun the need for the amendment and the associated exemption.
During this discussion the NRC Staff clarified that the two I)pe A Containtnent integrated Leak Rate Tests previously performed by NilY were " pre-operational" tests, ant the Type A test to be conducted during the upcoming refueling outage is considered to be the first
pe riodic" test.
With this clarification, there is no longu *, c.:n,0 c t between the existing Technical Specification test schedule requirements and the current testing schcdule since it is possible for NilY to conduct the third
- periodic' 'lype A test durira the 10-year insersice inspection shutdown.
The NRC Staf f also stated that a proposed revision to 10 CFR 50 Appendix J, is l

This rule change will further eliminate the need for NilY lo pursue License Amendment Request 91-07 and the associated exemption request.
flased on the foregoing, NIIY concludes that at this time it is not necessary to pursue License Amendment Request 9107, and the associated exemption sequest, and therclorc, withdraws the aforementioned request from NRC review.
