Letter from Mr. D. G. Mcdonald, Jr. (NRC) to Mr. G. C. Creel (BGE),

dated July 30,1991, ' issuance of Amendments for Calvert Clifts Nuclear Power Plant, Unit No.1 [ TAC No. 80488] and Unit No. 2 [ TAC No. 80489j" l

We hereby withdraw our October 27, 1995, request for approval of a revision to our schedule for withdrawal of reactor vessel material surveillance capsules for Calvert Cliffs Units I and 2 (Reference a).

Since the surveillance capsule withdrawal schedule is no longer part of the Calvert ClitTs Techn cal Specifications (Reference b), our request was made in accordance with Appendix H of 10 CFR Part 50, and not as a license amendment request. However, we understand that the staff is now treating such applications as license amendment requests because of a recent decision by the Atomic Safety and Licensing Board against the Commission. He decision is currently under appeal. Since the revised I

schedule will not be needed in the near future, we have decided to withdraw our request at this time. We will consider resubmitting at some future time either under Appendix H or as a license amendment request, depending on the outcome of the NRC's appeal.
