Pursuant to the provisions of 10 C.F.R., Part 9, Long Island Lighting Company ("LILCO") hereby submits a request under the Freedom of Information Act, 5 U.S.C. S 552, for certain records in the possession or control of the Nuclear Regulatory Commission ("NRC"). LILCO requests that it be furnished copies of all records, as that term is defined in 10 C.F.R. S 9.3a(b), conforming to the following descriptions:

(1) The Freedom of Information Act request submitted by Robert Belair on behalf of the County of Suffolk, State of New York

("Suffolk County") on or about April 4, 1984; (2) Copies of all records produced and made available to Suffolk County by NRC pursuant to the Freedom of Information Act request identified in item (1) above; (3) Aay response to the Freedom of Information Act request identified in item (1) above indicating that any requested records do not exist, are unavailable to NRC or are exempt from public disclosure pursuant to 5 U.S.C. S 552; 0179 g404C PDR 23

f (e) All communications between NRC and any representative of Suffolk County concerning radiological emergency planning and

responso relating to the Shoreham Nuclear i Power Station, located in Suffolk County, New York (currently the subject of licensing proceedings in Docket No. 50-322 (OL)), including all such communications-relating to generic radiological emergency 4 planning issues. For purposes of this request, the term " representatives of Suffolk County" should be construed to

!_ include any elected official of Suffolk County, any employee of Suffolk County, any consultant employed by Suffolk County, any employee of the law firm of Kirkpatrick, Lockhart, Hill, Christopher & Phillips or any other attorney _ representing Suffolk County or its elected officials; i

(5) Any communication between NRC and

! representatives of the State of New. York l concerning radiological emergency planning l relating to the Shoreham Nuclear Power

Station, Suffolk County, New York, e including all such communications relating l to generic radiological emergency planning

issues. For purposes of this request, the term " representatives of the State of New York" should be construed to include any elected official of the State of New York, any employee of the State of New York, any consultant retained by the State of New York or any attorney or law firm representing the State of New York or any of its elected officials.

LILCO hereby requests that any documents which'NRC I makes available t'o Suffolk County pursuant to the County's Freedom of Information Act request be simultaneously made available to LILCO's representatives at the address indicated I above.

those responsive to Suffolk County's request, and consequently l

Huxrox & WILLI AMN may require additional search time beyond that required to respond to Suffolk County. As to such records, LILCO anticipates that NRC will respond within the time allotted nader the provisions of 10 C.F.R. S 9.8.

LILCO understands that compliance with this request may entail search and. reproduction costs, and that it may therefore be requested, pursuant to 10 C.F.R. 5 9.14, to make prepayment of the anticipated fee. Upon request, LILCO will make prompt payment of any fee established by the Freedom of Information Act Officer. Communications regarding such payment should be addressed to the undersigned.
