Licensee.herein responds to the Aamodts' Reply,.as amended, addressing only that facet of the Aamodts' Reply relating to Licensee's provision of information to the Commonwealth on March 28, 1979;2/

The Aamodts' Reply is inaccurate.
The Aamodts state on 4
4 page 5 that Licensee wrongly claimed Thomas Gerusky had "'cor-rected' his May 3, 1979 testimony on which Gamble had depended for his conclusion that TMI personnel had lied concerning 2/
In the Aamodts' " Motion for Reconsideration of Commission order CLI-84-22 and Opening of a Hearing" (Jan. 15, 1985),
the Aamodts claimed that TMI personnel discounted proj-ected releases of 10 R/hr over Goldsboro by claiming, con-i trary to fact, that surveillance. teams had been dispatched and had verified that a significant release had not oc-curred.
The Aamodts referred to a draft of a section of NUREG-0760, which had been attached to the recent testimo-ny,of David Gamble in the remanded restart proceeding; that draft in turn referred to a May-3, 1979 NRC interview of Thomas Gerusky.
Mr. Gerusky's interview suggested that offsite measurements at Goldsboro had been reported prior to 8:00 a.m. and used to discount the Goldsboro projec-tion, whereas other evidence indicated that a reading was not taken at Goldsboro until about 8:30 a.m.

The Aamodts are wrong for several reasons.
First, Licensee did not state that Mr. Gerusky had "cor-rected=3/.his " testimony" -- a phrase that might connote formal transcript correction.
Rather, Licensee indicated that the NRC had subsequently explored, in an October 1, 1980 interview of Mr.-Gerusky, the substance and timino of communications between Licensee and the BRP concerning the Goldsboro dose rate projec-tion.1/
Based on this interview and NUREG-0760's subsequent treatment of this subject, Licensee concluded that the matter discussed in the Aamodts' motion had been " clarified" long ago.
Second, Licensee is unaware of the basis for the Aamodts' assertion that David Gamble concluded TMI personnel had lied.

The Aamodts apparently rely on early drafts of sections-of NUREG-0760 (sections draf'ted prior to Mr.
Gerusky's second interview) which the Aamodt.s refer to as the Gamble drafts and attach to their motions.
Mr. Gamble, howev-er, was not the author of these drafts.

The'Aamodts also rebuke Licensee for allegedly not providing a specific citation to Mr..Gerusky's October 1, 1980 interview. ' Licensee, however, specifically cited pages 33-41 of that interview.

Moreover, Licensee attached the pages to its Response.. _.. _ _
attachments to Mr. Gamble's recent testimony in the remanded restart proceeding, profferred solely to support his criticism that NUREG-0760 investigators had predrafted portions of that report and not for the truth of the matter asserted therein.
Third, the Aamodts misuse the Gerusky October 1980 inter-view.
On page 7 of the Aamodts' Reply, the Aamodts quote por-tions of two answers from pages 39E/ and 41 of Mr. Gerusky's October 1, 1980 interview in an attempt to discredit Licensee's and the Staff's analyses.
In selecting these quotations, the Aamodts ignore the parts of the transcript that contradict their position and which place the quoted portions in context.
Before giving the particular answers quoted in part by the Aamodts, Mr. Gerusky was questioned at some length on the sub-stance of and sequence in which information concerning Goldsboro had been received:
Q Do you recall what was told you --
what specifically was told you which caused you to no longer give any cred-ibility to the 10-R per hour reading?
I'm talking about surveys.
What sur-veys were made, for instance?
A Yeah, we were told that there were no onsite readings of any consequence, in that wind direction.
We were also told that the containment pressure was still very, very low, and that this was designed -- that the calculation 5/

So the explanation that.
went along with this was that if we are_following procedures,'our-proce-l_

However, it's not at_ design lead. pressure, so these num-i bers aren't real.
However, we aren't going to take any chances.
We are
. going to send a team over to check it out, and then we notify PEMA or Civil Defense to be prepared to evacuate people on the west shore.

So let me make sure I understand it.

First you learn-

sure and those things, and than at the tail end of.that conversation, you got the calculated reading._
Is that the order?
A-That's about what:I remember.
Q All within this1 general conversation?
A Yes.
And I was asking questions while all this was going on, Maggie was asking questions.
"Do you have any people over there now monitoring?"
"No, we are starting to send people over."
I was.under the impression they were going to go over by helicopter,.for some unknown reason.
I don't believe they went over by helicopter.
I thought there was-a helicopter there and they were going over by helicopter and get the readings.
They got the readings very quickly.
At least the time was going by so darned fast.
When we got the word back that they didn't have any detectable activity over there, it apparently was a lot longer period of time than I had an-ticipated, early on, anyway.
BY MR. MOSELEY:
Q So there was action taken to notify PEMA after the first prediction?
A Yes.
Q-And then some time elapsed before PEMA was called back and said --
A Yes, they have in their logs what that time was, and it appeared to be like an hour or something. 'But I don't re-member.
BY MR. GAMBLE:
Q And was it the reading on the other side of the river that precipitated this second call to PEMA?
A Yes.
Q It wasn't an onsite reading, it was the actual reading.
A No', it was the actual reading from across the river saying they had found i
no detectable radiation across the river in Goldsboro or down in the gen-eral vicinity.

Mr. Gerusky made it clear, therefore, that the Goldsboro projection was initially discredited on the basis of onsite

r readings and the low containment pressure -- and not on the basis of offsite readings at Goldsboro.
Mr. Gerusky was then questioned on the times at which information concerning Goldsboro was received.
When the portions of Mr. Gerusky's re-sponses which the Aamodts quote are read in context, it is evi-dent Mr. Gerusky was responding that information on the Goldsboro projection and onsite measurements was received per-haps sometime between 7:30 and 8:00 and were reported to PEMA at that time,-that the actual measurements at Goldsboro were subsequently received and reported in a second call to PEMA, and that the PEMA log indicated that the interval between the two calls may have been "an hour or something".5/

Next, on page 9 of their motion, the Aamodts state, the Licensee and the Staff responses made no mention of the testi-f mony of two other BRP employees, William Dornsife, a nuclear s
f' engineer and Margaret Reilly, a health physicist, who also f/f f3ubsequert to Licensee's Response of January 25, 1985, Li-censee obtained what is either a retyped copy of the PEMA log or abstracts from that log.
This document is atta-ched.
It indicates that the BRP informed PEMA at 7:45 a.m. that there was a [ projected] offsite release in the direction of Brunner Island and Goldsboro.
Subsequent calls from BRP to PEMA were logged at 8:15 and 8:35 a.m.
Neither of the abstracts of these calls mentions readings taken at Goldsboro.
Licensee is therefore unable to de-termine with certainty to which of these log entries Mr.
Gerusky was referring in his October 1980 interview. 1.

testified,-along with Gerusky on May 3, 1979."
Licensee, how-ever, found no statements by either of these individuals in the May 3, 1979 interview the.t were material to the matter raised by the Aamodts.
The Aamodts themselves only re'ci to a state-ment by Mr. Dornsife that: "The next notes we have is, about 8:30.
From this, the Aamodts speculate that all the times mentioned in the May 3, 1979 interview were based on notes and therefore accurate, and that no significant informa-tion was reported between 8:00 and 8:30.
There is, however, no basis for concluding that Gerusky's account of notifications to PEMA was based on notes.
The notes to which Gerusky referred were identified by him as'the notes of Dornsife, who had been on the phone in contact with the Unit'2 control room, and the note taken by Dornsife at 8:30 referred to his conversation with Gary Miller as to the plant status.
The Aamodts further speculate that Mr. Dornsife would not have been able to prepare for a briefing with Lieutenant Governor Scranton without having received confirmation concerning offsite readings (presumably for some reason prior to 8:00 a.m.).
Contrary to the Aamodts' speculation, however, Mr. Dornsife told the NRC in an October 1, 1980 interview, that he was not aware of the predicted dose rate at Goldsboro until later in the day, probably after he re-turned from the Lieutenant Governor's briefing.

The Aamodts also attempt to obfuscate the Goldsboro issue by referring to statements by Gary Miller and Richard Dubiel, which evidence uncertainty as to when and'how the offsite moni-toring teams were dispatched to Goldsboro.- Aamodts' Reply at 10-12.
These statements are recounted at pages 6-11 of Attachment B to the Aamodts' Reply and have little relevance to what information was pasced to the BRP prior to 8:00 a.m.
Finally, the Aamodts-ignore'the gravamen of Licensee's re-sponse -- that Licensee's reporting of information concerning the projected dose rate at Goldsboro is a matter that was raised and explored years ago.
There is no significant new ev-idence that would support a motion to reopen.
For all of the reasons above, Licensee submits that both the Aamodts' - " Mot' ions to Address False Statements in Response to Aamodt Motion of January 15, 1985" and the Aamodts' " Motion for Reconsi'deration of Commission Order CLI-84-22 and Opening of_a Hearing" should be denied.
