The NRC commissioners met in a closed session to discuss " Future steps to TMI-1 restart" on Jan. 24, 1984. The meeting was closed under exemptions 5 and 10 of the Government in the Sunsine Act, according to the NRC's official notice of the meeting.
On Feb. 10, 1984, the U.S. Court of Appeals for the District of Columbia Circuit, ruling in Philadelphia Newspapers Ind
- v. NRC (D.C. Civil No. 83='1698 ),
said, "Specifically we hold that all discussionc of non-nexus issues, interim restart, and final compliance with the Licensing Board's safety recommendations must ba open to public observation." The court specifically decided that exemption 10 could not apply to interim restart discussions.
Accordingly, under the Freedom of Information Act, 5 U.S.C. 552, I request that you make available to me copies of the transcript of the Jan. 2h,198b meeting referenced above.
