CERTIFICATION ON EXCLUSION OF TESTIMONY OF FORMER NUCLEAR REGULATORY COMMISSIONERS PETER BRADFORD AND VICTOR GILINSKY 1

urges the Appeal Board to accept certification of the questions presented and to direct the admission of the evidence in i

We believe the following arguments are most
'I persuasive:
1.
Given the ambiguity of NRC reporting requirements, the i
Commissioners are the best, if not the only, source of I
information on the materiality or the information conveyed and
.I
-i not conveyed by Mr. Dieckamp to the contemporaneous decisions i
taken and contemplated by the Commission.
There is no other
!i it

credible source of evidence on this subject.

Dr. Gilinsky's conversation with Mr. Dieckamp j.

indisputably prompted the mailgrua.
His testimony is clearly j.
relevant to Dicckamp's state of mind, which is one of tne central 1
1 issues presented.

.GPU has presented opinion evidence on many of the same 5

subjects,'particularly-the interpretation which " experts" placed or.would have placed on the:information available during the accident. -(See TMIA Memorandum of Points and Authorities, pp.
S' 19-21)
The obvious purpose of the GPU testimony is to argue that' A.-l the data on the1 pressure spike'would have_been of no value to the f
)
Commission in its deliberations and hence was-not material.
The former Commissioners are in a position to rebut this claim.
It a
l is manifestly unfair.to allow GPU to present this evidence but-to i
deny TMIA an opportunity to meet it.
4.
The NRC rules specifically permit the subpoenaing of 3
I witnesses whose testimony has relevance but who cannot or will not provide prefiled testimony as a witness for a party.

j the argument that this would be unfair is unpersuasive.
Moreover, GPU has Mr. Bradford's deposition, could have ' deposed Dr. Gilinsky and clearly has the resources and ability to fully mitigate any surprise.
Indeed, the Zebroski and vanwitbeck testimonies are substantially pre-emptive rebuttal of the a
Bradford and Gilinsky cvidence.

The Ethics in Government Act is inapplicable to the i
Sworn testimony of facts within the personal knowledge of the 1
individual and to opinions derived therefrom.
