Dear Mr. Patten:

         -Lehigh County is serving as a support county for Berks and Montgomery Counties in the event of an emergency at the Limerick Generating Station.

We are attempting to finalize our support RERP plan and have only one item outstanding; a copy of the host school agreement between the Southern Lehigh and Pottsgrove School Districts. Energy Consultants has informed me that the two school districts have reached a stalemate in attempting to draft a mutually acceptable hosting agreement. Apparently, language added to the agreement making Pottsgrove liable for costs incurred to Southern Lehigh in serving as a host (student pick-up point) is unacceptable to Pottsgrove. Robert Bradshaw cf Energy Consultantt (2101 N. Front St., Riverside Office Center 3 Harrisburg, Pa.17110 717-236-0031) has been working on this agreement. We. have completed Draft 4 of our support plan, and can go no further until this matter is cleared up. If you have any questions concerning the progress to this time, a call to Mr. Bradshaw would be in order. The Lehigh County Office of Civil Defense is requesting that PEMA legal counsel review the attached copy of the draft host agreement and determine the applicability of P.L.1332 regarding liability in an emergency. Any information in this regard that can be communicated to the two concerned school districts to complete the agreement, would be greatly appreciated.

i Lehigh County's primary concern in this matter is resolution of the host school arrangements so that the Office of Civil Defense may finalize our support plan. Should Southern Lehigh and Pottsgrove not be able to come to mutual agreement, another host district will have to be identified. Due to the large number of .tudents and logistics involved, it is doubtful that another Lehigh County school district would be capable to serve as host. For obvious reasons, it is hoped that this matter can be resolved expeditiously. - Thank you for your attention to this matter.
