20555 Re Long Islat.s Power Authority (Shoreham Nuclear pswar Station. Unit 1)

Dear Mr. Scinto I am writing on behalf of the Long Island Power Authority ("LIPA") in response to your letter of June 5, 1992.

As you know, LIPA has entered into a Settlement Agreem,1t dated June 1, 1992 with the Shoreham-Wading River Central School District ("SWRCSD") and Scientists antf. Engineers for Secure Energy, Inc. ("SE2") Whereby SWRCSD and SE2 have agreed to dismiss with prejudice all of their proceedings at the and the U.S. Court of Nuclear Regulatory Crmmission ("NRC")

Appeals for the District of Columbia Circuit.

LIPA agroos with your conclusion that no provision in the Sottlement Agreement or in the June 1. 1992 f.greement between LIPA, SWRCSD, the Town of BrocP. haven, and suffolk County would restrict the ability of any person from communicating with the NRC at any time with respect to any cafety cencarns that such person may have about decommissioning or any ocher aspect of Shoreham nuclear facility catety.

LIPA wishes to note further that the Settlement Agreement specifically states that "all Parties consider it in the best interest of the people of Long Island and each Party to terminate all (pending) litigation."
