written response to the Notice of Violation (NRC INV NO 2
4-94-010)
- 1. Violation of 10 CFR 50.5 (a) (2):

Sawyer do hereby dispute any and all accusations made against me as outlined in Notice of Violation letter IA 95-047. Especially the accusation of falsification of the HSF block. At no time in my career have I falsified nor instructed any technician working for me to falsify or intentionally create or recreate a survey that was NOT performed. Due solely on the complexity of my response I requested and received a meeting with Jonathan Armenta and Charles Kane on November 13, 1995. As part of my formal response I request a transcript of this meeting for my records and to make my attorney aware of what was put into the investigation based on my interview.
- 2. Corrective steps taken and results acheived:
a.) SEG's corrective action was to remove myself from the Fort St. Vrain project and force my resignation dated 8/15/94 b.) The results were negligable at best based on the fact that to this date the are as many or more problems than there was at the time of my termination from site. This project was doomed from its conception, problems that were i
brought to light were passed up through the chain of command j
and squashed at the levels of Dick Sexton and Ed Parsons.

Even when Oakridge management (Neely and Arrowsmith) did happen to get vind of concerns or problems they, in conjunction with Sexton and Parsons quickly shuffled them under the carpet and expertly covered their tracks with a smoke screen. As the dayshift RP Supv I was told many times to " Shut up and do your job" or "That's not your concern".
At many times throughout the project " upper management" deliberately intimidated me and forced me to work in an atmospnere of subversion and duress if I did not "Do my job!'.

Corrective steps that will be taken to avoid further violations:
4 Due to the carefully choreographed and premeditated nature of an investigation, that most people would call a
" WITCH HUNT", in which I was accussed of falsifying a HSF block survey even though there were many people who witnessed me doing the survey. This does nothing more than tell me that the investigation team had to find people that were expendable and they did just that. However, during the investigation the nightshift supervisors' name was on as many or more of the so called falsified surveys! Was this individual, Mike Miles, persecuted like I was? the answer is NO !
My corrective action is to retire from the nuclear industry after what I thought was 14 years of dedicated service to a profession that I still very much care about and enjoy. However the true corrective action vill have to come from you, the NRC do your own investigation and then pass judgement. for instance find the original MORT Report, read my deposition, I don't think anyone even heard what I said. In my opinion the SAM report was nothing more than a case of bureaucratic lip service to both myself and Ken Zahrt.
