Pursuant to the Board's request (Tr. S-91, S-94), Suffolk l County hereby identifies the persons whom the County seeks to have designated as " authorized persons" according to Paragraph 1(b) of this Board's August 17, 1984 Protective Order. We have indicated below each individual's name, address, and occupation, whether he or she was an " authorized person" as defined in the Brenner Board's Revised Protective Order Governing Access to Security Plan Information, dated June 9, 1982 (hereafter, June 1982 Order) (a copy of which is attached for the Board's'informa- -

Commissioner Dilworth has since retired. Because Chief Roberts and Inspector McGuire report to Commissioner Treder, it is neces-sary for Commissioner Treder to be free to discuss the details of that plan and the work being performed with the officers who are accountable to him.

Lieutenant Compitello was an " authorized person" under the June 1982 Order and signed the Affidavit of Non-Disclosure

. attached to the 1982 Order. Chief Monteith and Inspector Turano were authorized by LILCO to consult on safeguards matters with counsel and authorized experts, due to their affiliation with the Suffolk County Police Department. See Suffolk County's Notifica-tion of Additional Person Having Access to Security Plan Informa-tion dated July 21, 1982. Lieutenant Compitello, Chief Monteith and Inspecto: Turano were witnesses on behalf of the County in the 1982 security proceeding. They have worked closely with Chief Roberts and Inspector McGuire on security-related matters and will. materially assist the County in being able to present its case. Since they already have had access to safeguards information, their designation as authorized persons in the instant proceeding will not broaden the number of persons with access to safeguards data. Attached hereto are copies of the resumes of Lieutenant Compitello, Chief Monteith and inspector Turano.

Third, Suffolk County seeks to have designated as an

Johnson August 24, 1984 Page 7 Responsibility requires that counsel be able to consult with the client being represented so that the client's interests can be properly and effectively asserted by counsel. The authority to make decisions on the merits of a. case is exclusively that of the client, not the lawyer, and the lawyer is obligated to exert his or her best efforts to ensure that the client's decisions are made only after the client has been fully-informed of relevant facts. See Ethical Considerations EC 7-7 and 7-8.

Deputy Suffolk County Executive Frank R. Jones was author-ized under the June 1982 Order "to consult with the [ authorized]

lawyers and expert consultants regarding safeguards information on a 'need to know' basis; however, he (was] not authorized to have access to the documents which themselves contain safeguards information." June 1982 Order at 2. The County has recently designated Chief Deputy County Executive John Gallagher, rather than Mr. Jones, as the representative of Suffolk County with whom counsel should consult concerning the County's position in this security proceeding. Accordingly, we request that Mr. Gallagher be authorized to consult with the authorized attorneys and expert consultants regarding sa'feguards information under the same terms as those set forth for Mr. Jones in the June 1982 Order. Thus, Mr. Gallagher would not have access to any documents containing safeguards information, but would be free to consult with counsel on a "need to know" basis regarding critical decisions in the County's conduct of this case. An Affidavit of Non-Disclosure in the form provided by the Low Power Board on August 16 has been sent to Mr. Gallagher and when an executed copy is received, it will be submitted to the Board. -

Fourth, Suffolk County requests that Gregory C. Minor,' a i

principal and consultant with MHB Technical Associates, 1723 '

Hamilton Avenue, San Jose, California 95125, be designated an

" authorized person" who is' authorized to consult with the author-ized attorneys and expert consultants identified above regarding safeguards information on a "need to know" basis. The County does not seek authority for Mr. Minor to have access to the LILCO security' plan itself; however, Mr. Minor, as an expert concernin'g the technical aspects of plant operation needs to be able to consult with security experts and counsel so that the County may conduct discovery, prepare testimony, and otherwise participate in this security litigation which concerns, among other things, '

the potential impact of the design basis threat upon the safety of the plant's operation. For instance, it is essential that the ,

security experts be able to consult with Mr. Minor to obtain his opinion on whether a particular security threat would have the potential to result in radiological consequences. In such con-

Minor has signed the Affidavit of.Non-Disclosure attached to the June 1982 Order. In addition, a copy of the Affidavit of Non-Disclosure provided by the Low Power Board on August 16 has been sent to Mr. Minor and an executed copy will be submitted as soon as it is received. A copy of Mr. Minor's professional qualifica-tions is attached hereto. Any notes or pleadings containing safeguards information will be kept by Mr. Minor at the office of Kirkpatrick, Lockhart, Hill, Christopher a Phillips.

Final,lg, although the County does not seek to have a fourth attorney authorized to participate in these low power proceed-ings, we inform the Board that Michael S. Miller, also with the firm of Kirkpatrick, Lockhart, Hill, Christopher & Phillips, is an " authorized person" under the June 1982 Order and has signed an Affidavit of Non-Disclosure attached to the June 1982 Order.

Mr. Miller was one of the primary attorneys involved in the

  • security proceeding which took place in 1982, and has had contin-uing involvement subsequent to 1982 in matters arising out of that proceeding. Pursuant to the terms'of the June 1982 Order and the Affidavit of Non-Disclosure which has been executed by Mr. Miller, it is anticipated that he will continue to perform that role, and, insofar as what happened in that proceeding may be pertinent to what happens in this low power proceeding, Mr.

Miller may be called upon infrequently to consult with the three counsel identified herein as authorized participants in this low power proceeding. However, since Mr. Miller is now engaged in the emergency planning case before Judge Laurenson, it is not y anticipated that Mr. Miller would be available to become active '
