Docket No. 50-322-OL-4 (Low Power)
Dear Judges Miller,
Bright and Johnson:
This will respond to Suffolk County's request for a postponement of the conference of counsel now scheduled for Thursday, August 16.
The Aui,mst 10 letter from Mr. Dynner to the Licensing Board was received by LILCO this morning, though LILCO did indicate by telephone on Thursday, August 9, that it would not agree to any schedule change.
LILCO opposes any postponement which could prolong these low power proceedings.
If any security contention were to be admitted in this proceeding, Suffolk County would undoubtedly contend that any schedule leading to hearing should i

Bright Judge Elizabeth B. Johnson Page 2 August 13, 1984 not begin until after the conference of counsel to discuss security issues.
Thus, by granting Suffolk County's request to postpone the August 16 conference of counsel, valuable time might be lost.
Additionally, LILCO fails to understand why the absence of Lawrence Lanpher should in any way affect the County's ability to discuss any security issues to be raised.
No such notion was raised by the County on August 7 when the Board scheduled the August 16 conference.
Indeed, the Licensing Board will no doubt recall Ms. Letsche's insistence that she be privy to safeguards information because this was "her case" and she would be handling the security issue.
Moreover, Mr. Lanpher was not present during the evidentiary hearing held from July 30 through August 7.
Finally, if Mr.
Lanpher is out of the country, then he could not have been instrumental in formulating any proposed security contention which must be filed today.
Accordingly, LILCO opposes the requested postponement.
Thank you for your consideration of this matter.
V uly your,
