Request for Information Pertaining to 10 CFR 26, " Fitness for Duty Program"
Dear Mr. Pirtle:
Enclosed herewith you will find a package containing records you requested from Toledo Edison (TE) pursuant to 10 CFR 26.70 during a recent inspection at the Davis-Eesse Nuclear Power Station (DBNPS).
Legal counsel for TE has reviewed your request and agrees that the NRC is authorized access to documents, records and reports relating to the implementation of 10 CFR 26 at the DBNPS.
However, due to the nature and content of the records provided herein, TE believes that these records are specifically exempt from public disclosure by the NRC, pursuant to 10 CFR 2.790(a)(6), which states:
" Personnel and medical files and similar files, the disclosure of which could constitute a clearly unwarranted invasion of personal privacy."
Toledo Edison considers all information of the type being provided herein to be personal, confidential or medical information, and thus, is considered exempt from disclosure.
Please handle the information accordingly.
