50-416 OLA Gentlemen In the Licensing Board's April 23, 1984 "Second Order Following Prehearing Conference (Admitting Intervenor and Ruling on Contention)", the Board ordered that each party file a' status report by August 1, 1984. The report is to advise the Board of "all unresolved matters preparatory to hearing and of the parties' respective suggestions as to the dates for scheduling

To date the Licensees have received no discovery requests from Jacksonians United for Livable Energy Policies (JULEP). On ~

July 30, 1984, Licensees served a First Set of Interrogatories on JULEP. NRC Staff Counsel has advised that Ms. Stewart, Chairperson of JULEP, advised her by telephone today (August 1, 1984) that JULEP intended to withdraw its request for hearing in this matter and that JULEP would confirm this in writing.

Licensees are prepared to propose a schedule for remaining discovery, summary disposition, final prehearing conference, if necessary, pre-filed testimony, if necessary, and a hearing, if necessary, in accordance with the Board's April 23, 1984, order, and had in fact reached agreement with the NRC Staff on such a 2408030001 840001 PDR ADOCK 05000416 Q PDR - ,__ . - - _ _ - _ -

I schedule in contemplation of a conference call with Ms. Stewart, which had been rescheduled to today at her request. However, under the circumstances, it would appear that the Status . Report should be deferred pending written confirmation of JULEP's withdrawal from this matter.
