LILCO'S APPLICATION FOR ISSUANCE OF SUBPOENAS Pursuant to the Board's ruling of July 12, 1984 (Tr.

12,829-34), Long Island Lighting Company (LILCO) requests the presiding officer of this Licensing Board to issue subpoenas under 10 CFR Section 2.720 to command the appearance of and testimony by James Hines and Frank A. Cipriani at the emergency planning hearings. Counsel for Suffolk County and counsel for the State of New York have orally represented that they will not voluntarily produce these two people as witnesses. In ad-dition, pursuant to the Board's July 12 order (Tr. 12,834) p LILCO has attempted to reach an agreement with the parties to

avoid the necessity of requesting subpoenas; these discussions gh have not borne fruit.1/ The parties have agreed, however, upon S8 '

@ witnesses voluntarily for depositions or as witnesses at the gh, hearings, and did not offer any counter-proposal regarding the issues of (1) providing a foundation for the two letters signed by these gentlemen and offered into evidence by Suffolk County, and-(2) af fording LILCO discov ry regarding these letters.

The testimony of Messrs. Cipriani and Hines will produce information of relevance to the emergency planning issues raised in Contentions 74 and 75 regarding relocation centers (see 10 CFR S2.720(a)). These gentlemen are the signators of letters dated' July 21, 1984 addressed to the American Red Cross and discussing the availability of f acilities relied upon by LILCO and the Red Cross as relocation centers. Suffolk County has of f ered those letters into evidence as part of its revised testimony on relocation centers. If the Board denies LILCO's pending motion to strike those letters as lacking foundation (see Tr. 12,831, lines 7-18), it is necessary that Messrs.

Cipriani and Hines appear is witnesses to allow LILCO to ade-quately explore the contents of the letters.

For -the reasons stated above, LILCO asks the Board to issue 1 subpoenas for the appearance of Messrs. Hines and Cipriani at the hearings on August 22, 1984, beginning at 9:00 a.m., to discuss the use of their facilities as relocation cen-ters i'n connection with the LILCO Transition Plan.
