1. My name is Donald O. Foster. I am an officer of Georgia Power Company and have been assigned the duties of Vice President and Project General Manager, Vogtle Project.

I am providing this affidavit for use in the above-referenced licensing proceeding and in particular in response to matters, allegations and averments set forth in ECPG/GANE's Amendment to basis for Contention No. 8. All of the information set forth in this affidavit is known to me through my own direct and personal knowledge or has been reported to me in my

capacity as an officer of Georgia Power Company and as Project General Manager, Vogtle Proj ect.
2. Georgia Power Company has conducted an investigation centered around unauthorized disclosure of bid information at Plant Vogtle. The investigation of bidding practices concerned primarily the purchase from one vendor of expendable supplies DOchohoghjj4 PDR i

g A used at the plant, including small tools such'as socket wrenches, rivet guns, gloves and the like. These items were not part of the power plant structure or systems and are not related to the quality of the plant. In fact, such small tools and other expendables are outside the regulatory re-quirements for safety equipment encompassed by Georgia Power Company's Quality Assurance Program.

3. With respect to the minimal amount of safety-related service work and safety-related-material provided by the vendor in question, Georgia Power Company has conducted special audits'and reviews of one hundred percent (100%) of such materials and services and has determined that there were no quality deviations in the work performed or materials supplied. Georgia Power Company has also determined that adequate controls existed and were applied at Plant Vogtle to ensure that supplied permanent-plant material, equipment and services furnished by the vendor in question met the require-ments of the engineering requisitions and purchase orders.
4. As a result of this investigation, Georgia Power Company discharged seven employees and ceased doing business with the vendor.

l 5. It is the Company's policy to report matters such l

as these to appropriate law enforcement agencies for whatever action they_ choose to take. That policy was followed here.
