Dear Mary:
In a telephone conversation earlier today, you informed me that a psychologist working for the NRC has handwritten notes of interviews with TMI reactor operators and that the notes fall within the scope of UCS' discovery requests.
You later informed me that you have determined that the notes are not subject to discovery because they are personal notes of the psychologist in question.
The purpose of this letter is to request that you assure'that these notes are not destroyed or otherwise made. unavailable.
We expect to make a motion to compel production of these notes if they are not provided.
We also believe that the Staff may not simply ignore the existence of these notes when it responds to our discovery request.
Rather, the Staff must acknowledge the existence of these notes and seek a protective order.
Until this matter is resolved, it is incumbent upon the Staff to assure that the documents that are the subject of this request are not destroyed and that they remain available for production.
