REFERENCE:
a) Letter from Mr. A. E. Lundvall, Jr. to Mr. James R. Miller of April 26,1984.
Gentlemen:
On July 6,1984, the Commission published in the Federal Register a final rule (see FR, Vol. 49, No.131, page 27733) concerning State and local agencies participation in annual emergency response exercises. This rule change had the effect of correcting a conflict in the regulations brought about by the approval of FEMA regulation 44 CFR 350.9 on September 28, 1983. Reference (a) was forwarded as a request for exemption from 10 CFR 50, Appendix E, section IV.F.1.a requirements. These requirements specified the frequency of participation by State and local agencies in the annual emergency response exercises.
With the approval of the final rule and its accompaning changes, we no longer perceive the need to pursue an exemption from 10 CFR 50, Appendix E. Accordingly, we request that you withdraw our request of April 26,1984.
