AMENDMENT 31 - APPROVAL OF EXEMPTION FROM TITLE 10 OF THE CODE OF FEDERAL REGULATIONS, PARAGRAPH 73.46(b)(9) (ENTERPRISE PROJECT IDENTIFIER L-2020-SPR-0006)
Dear Mr. Terry:
This refers to letter 20-023, dated March 19, 2020 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML20085F884), in which you submitted a request for exemption from certain requirements of Title 10 of the Code of Federal Regulations (10 CFR), Paragraph 73.46(b)(9) regarding Tactical Response Team and guard exercises, referring to the declared public health emergency for the United States to aid the nations healthcare community in responding to the Coronavirus Disease 2019.
The U.S. Nuclear Regulatory Commission (NRC) staff has completed its review of the request.
The NRC has determined that issuance of this exemption until August 31, 2020, is in compliance with law, will not endanger life or property or the common defense and security, and is in the public interest.
Pursuant to 10 CFR Part 70, Materials License SNM-42 is hereby amended to add Condition SG-6.9 as follows:
SG-6.9 Notwithstanding the requirements of 10 CFR 73.46(b)(9), the licensee is exempt from conducting Tactical Response Team and guard exercises through August 31, 2020, after such date the licensee commits to resuming normal operations and performing all missed exercises by December 31, 2020. Furthermore, the licensee commits to communicating with the NRC to reschedule the annual observed exercise on a mutually agreeable date.
All other license conditions shall remain the same. Enclosures 1 and 2 to this letter provide the amended Materials License SNM-42. The review of the NRC staff is documented in the Safety Evaluation Report, which is Enclosure 3 to this letter. This letter concludes action on this submittal and Enterprise Project Identifier L-2020-SPR-0006 is considered CLOSED.
The letter transmitted contains Security-Related Information. When separated from Enclosure 2, this letter is decontrolled.
