Intervenor herein, hereby files this, its Motion for Extension of Time to Respond to Applicants' Motion to Compel Answers to Applicants' Ninth Set of Interrogatories to CASE and Requests to Produce.

Since Applicants' Motion was received by CASE on 6/12/84, our answer.was due to be filed 6/22/84.

CASE's primary representative, who was answering Applicants' Motion, was unexpectedly asked by Ms. Billie Garde (who was in Texas for the taking of some depositions and to look at documents on discovery regarding the Intimi-dation portion of these proceedings) to assist her by helping review documents needed immediately This was necessitated by the sudden and unexpu.ted death of Ms. Garde's grandmother; she had to take a plane on Friday afternoon to attend the funeral. Mrs. Ellis, of course, agreed to assist. There were three Xerox boxes full of documents to be reviewed, and Mrs. Ellis spent the day reviewing them.

Because of this, by the time CASE's Answer to Applicants' Motion was completed, it was 3:30 A.M. on 6/23/84, necessitating this Motion.

In any event, CASE's Motion can result in harm to no one, since our Answer would not have been received by the Board and parties before Monday, 6/25/84, anyway.
