I am writing as chairman of the House Subcommittoo on Fisherios and Wildlifo Conservation and the Environment to request information regarding the Nuclear Regulatory Commission's (NRC) oversight of the dischargo of radionuclidos from the Pilgrim nuclear power plant in Plymouth, Massachusetts.
It is my understanding that before a plant operating permit can bo issued, Section 401(a) (1) of the Clean Water Act requires that the Environmental Protection Agency (EPA) or the stato must first cortify that an applicant's dischargos will be in compliance with stato water quality standards established under Section 301(a)(1) of the Clean Water Act.
In the case of Massachusetts, the state has established that its standards for radionuclido discharges are to be the same standards which EPA requires for safe drinking water.. However, I also understand that under a 1977 Homurandum of Understanding betwoon the EPA and the NRC, the EPA gavo NRC responsibility for the implementation and enforcement of radionuclido dischargo standards.
Consequently, I am writing to you to inquire about the monitoring program and compliance record of the Pilgrim plant with regard to radionuclido discharges.
Specifically, I would like to know the following:
- 1) Has Pilgrim boon cortified as meeting Massachusetta' water quality standards under Section 401 of the Clean Water Act?
- 2) How often are Pilgrim's radionuclido dischargos monitorod?
- 3) Who conducts the monitoring, and what samplos are taken?
- 4) What is Pilgrim's record of compliance with water quality standards?
Also, please outlino the relationeW p between the NRC, the EPA, and the State of Massachusetta in relation to this matter, and the respective roles that each entity plays.in promulgating, implementing, enforcing and monitoring regulations regarding radionuclido discharges.
