Dear Dr. Murley:

In Public Service Company of Colorado letter P 91138, dated May 15, 1991, it was requested that the Fort St. Vrain Initial Radiological Site Characterization Program be classified as information proprietary to Westinghouse Electric Corporation. In support of this request, an Application for Withholding Proprietary Information from Public Disclosure and affidavit, CAW 91-158, signed by Westinghouse Electric Corporation was provided. In a letter dated July 1,1991, the NRC informed Public Service Company of Colorado of th91r decision not to withhold the Radiological Site Characterization 3 Program as a proprietary document.

In response to. your letter of July 1,1991, which denied proprietary status, Westinghouse requests the withdrawal of the fort St. Vrain Initial Radiological Site Characterization Program, marked as Class 2 Proprietary and Class 3 non-Pro 3rietary, and replace it with the attached copy which contains a- l copyrig1t notice. The attached document is identical to the Proprietary version that was submitted except that the brackets that enclosed the information which is proprietary have been removed.

Although Westinghouse strongly disagrees with the NRC's determination that disclosure of. the document to the public would not cause substantial harm to the competitive position of Westinghouse / Scientific Ecology Group, the document is being withdrawn in order to facilitate the review and approval of the Proposed Decommissioning Plan. Mr. Mark Beaumont, of Westinghouse, will make-arrangements to pick up the copies of the document that were submitted.
