APPLICANTS' RESPONSE TO CASE'S REQUEST FOR INFORMATION ON POLAR CRANE SHIMS In its July 29, 1983 Proposed Initial Decision at p. 19, the Atomic Safety and Licensing Board (" Board") stated that with rega rd to polar crane shims "the Board does not believe that it is a matter which the Board should pursue sua sponte because it appears that the Staff and the applicant are addressing it."

CASE objected to the Board's ruling and stated its concern regarding Applicants' scheduled evaluation of the shims to determine if those which had been altered were acceptable for continued use. CASE's Objection to Licensing Board's Proposed +

Initial Decision at p. 15 (August 27, 1983). CASE stated that

"[A]lthough it is possible that this reinspection has been completed, CASE has not yet been informed or received anything indicating so." Id. Accordingly, CASE requested that the Board direct " Applicants to inform all parties to this proceeding as to the status of this reinspection." Id.

Although the Board denied CASE's objection, it did direct that in order to have a complete record, " CASE's request should I

l be honored." Memorandum and Order of September 23, 1983 at

p. 42. By Memorandum of March 15, 1984 at p. 6, the Board reiterated its request that Applicants supply CASE with information regarding the polar crane shims. Further, the Board stated that "[s]ince we requested that this information be supplied to CASE on July 29, 1983, Applicants also should be sure i to explain their tardiness in responding to the Board's request."

At the outset Applicants note that Applicants were not directed to supply additional information to CASE by July 29, i

1983 or any other date certain. Indeed, as noted above, CASE's

request for additional information regarding this issue was not even addressed by the Board until September 23, 1983. Applicants interpreted the Board's statement as directing Applicants to inform all parties when the final inspection of the polar crane

I With regard to the status of the inspection of the polar crane shims for clipped fingers, the inspection is completed, ten shims were discovered to have clipped fingers and all such shims have been replaced. See A f fidavit of C Thomas Brandt (attached).
