Dear Mr. Williamson:
As requested in the referenced letter, Public Service Company of Colorado (PSCo) herewith submits the " Report of Independent Counsel Investigation Concerning Issues of the Fort St.
Vrain Nuclear Generating Station Decommissioning Project" for your information.
This report documents the independent investigation performed by the law firm of Stier, Anderson and Malone into allegations of harassment and intimidation of workers and possible falsification of records at the Fort St. Vrain Nuclear Station (FSV).
PSCo considers that the enclosed report contains confidential information of a
sensitive
- nature, in accordance with the provisions of 10 CFR 2.790, and requests that the NRC withhold the entire report from public disclosure.
The report contains the following categories of information exempted from public disclosure under 10 CFR 2.790:
"(a) (6) Personnel and medical files and similar files, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy;"

The. attached' report, contains personnel and similar sensitive-information, divulging na.nes and actions of individuals working on the.FSV_ decommissioning project.who were purported to be involved in the-circumstances surrounding the harassment and intimidation l
allegations and possible ' falsification of records.
Individuals called to testify in this investigation were informed that their testimony would be held in strict confidence, and disclosure of the information contained-in the enclosed report would clearly constitute an unwarranted invasion of personal privacy.
Based on the above, PSCo requests that the NRC withhold the enclosed report from public disclosure, in accordance with provisions of 10 CFR 2.790, paragraphs (a) (6) and (a) (7).
