ON TIIE SIMPLIFIED BOILING WATER REACTOR (SBWR)

DESIGN, dated January 19,1995.

This letter is intended to clarify misunderstandings evidenced in your Reference 1 letter dealing with the Proprietary Enclosure to our Reference 2 submittal. The information that is proprietary in the Reference 2 submittal is the detailed results of test programs contained in the 3 1/2" magnetic diskettes which were enclosed with the written responses in the Question / Response text. The responses refer to files on the diskettes and provide instructions and other clarifications making the diskettes useable to the NRC Staff. The synergy between the written re.sponses and the files on the diskettes makes it prudent to deal with them as one Enclosure and make the package Proprietary. We have reviewed the Affidavit submitted with Reference 2 and believe that examples (4) a. and b. clearly cover the material transmitted in the Enclosure to Reference 2.
