" financial qualifications" contention. This filing was made in. light of the recent decision of the United States Court of Appeals in New England Coalition on Nuclear Pollution v.

NRC, No. 82-1581 (D.C. Cir. Feb. 7, 1984).

Since the issuance of that decision the Commission has ,.

issued a statement directing Licensing Boards to treat the rule which was the subject of the above referenced decision as being still. valid.
