NOTICE OF VIOLATION - BURNS INTERNATIONAL SECURITY SERVICES - EA 94-012

This has reference to the above matter. Under date of January 26,1994 the Commission issued a proposed Notice of Violation in the above matter.

Specifically, the Notice of Violation included a proposed Security 12 vel III violation against Burns and a Proposed Imposition of a Civil Penalty in the amount of $50,000 for a Severity Level III violation against the licensee Northern States Power Company.

The January 26,1994 proposed Notice of Violation stated in pertinent part that the Commistion's enforcement action in this case "is based on the Recommended Decision and Order of the DOL AU." The Commission noted that the ALJ's i

Recommended Decision and Order was being reviewed by the Secretary of Labor and as such any implementation of the fine and relevant portions of the enclosed Notice were placed in abeyance until thirty (30) days following the Final Decision and Order of the Secretary of Labor.

1 Under date of May 24,1995, the Secretary of labor issued his Final Decision and Order in the matter of Susan Yule v Burns International Security Services Case No. 93-ERA-12. The Secretary has ruled, inter alia, that Burns' action in terminating Yule's employment did not violate the Energy Reorganization Act of 1974, wherein he set aside the Administrative Law Judge's Recommended Decision and Order issued on June 24, 1993 and dismissed the matter in its entirety.
