The following notes reflect GEs perspective on the subject meeting with GE and EPRI at -

the GE Nuclear Energy Video Conference facility in San Jose, California, and the NRC and l DOE at the DOE Video Conference facility in Germantown, Maryland. The~ visual aids used ' l at the San Jose facility are attached. The objectives of the meeting were: 1) to assure t communication among the interested parties (NRC, DOE, EPRI, and GE) regarding the  !

information to be provided. in document submittals; 2) review commitments between the j applicant and the NRC; 3) identify any issues;' and, 4) agree on ac_tions. The ' meeting l

objectives were accomplished, and the efficiency of the interaction method (Video Conference) - ,

and the resultant savings in travel costs and time were generally acknowledged.  !

' GE presented an overview of the SBWR Commitment Tracking System which had been j reviewed in much greater detail with NRCs Jim Wilson on June 15-16, 1995 at GE in San: .

j Jose. GE also reviewed the status of the test and analysis programs. It was agreed that the- 'l test programs were progressing well and it was noted that significant additional test results will l become available for NRC review throughout the balance of 1995. The analytical plan was - i discussed with emphasis on key document submittals for NRC review.  ;

i

' A number of issues regarding review schedules were identified:

1) The review of previous NRC TRACG submittals: l 1

- Responding to the recent receipt of 86 RAls on the Qualification LTR' document is a  :

challenge since the original technical staff who prepared the documents are not generally i available. GE does not understand the delay in providing these RAIs, since according to NRC 1 billing records, the key review seems to have been perj)rmed between June 1993 and t

- Additionally, these RAIs were unexpected based upon the prior. discussions on this topic between GE and NRC and their consultants. This situation emphasizes the need for timely review of submittals to reach closure on these important documents. NRC agreed to expedite a.teleconference between GE, NRC and BNL to discuss the 14 (of the 86) RAls of most -

concern to GE.

2) The projected time to review scheduled future submittals:

The dates provided by the NRC staff to review scheduled future submittals will significantly impact the SBWR schedule. Examples include: four months to review the TAPD Rev. C which will be issued at the end of August 1995; October 1995, for the DSER of the TRACG Model LTR which was submitted February 1993, and for which RAIs were received and answered; no committed date for the Qualification LTR submitted February 1993, and for which RAls were just received and GE responses are being prepared; and finally, a two (2) year schedule for review of the three TRACG final submittals even though the current versions at NRC are already receiving extensive review.

3) Closure of Vacuum Breaker Exemption Request No action has been taken by the NRC on the February 1995, GE letter requesting NRC review. The NRC agreed to assess what will be required in terms of resources and time to complete this review. The NRC has reviewed the details of the valve, and witnessed the tests in May and October 1994, and received the test reports. .

Identification of these issues for resolution is a positive result of the meeting. Followup action is required. The constraints on NRC resources are recognized but the impacts on the SBWR Program could be severe and thus a constructive dialogue seems to be required. GE recommends this take place in about one month, which will permit closure on the already identified actions.

We have reviewed your Reference 1 letter and appreciate your efrort in evaluating our Februaq 14 letter (Reference 2). This letter addresses our specific expectations from the NRC for documentation of the NRC review of the key near term SBWR Technology Phase submittala.

Test and Analysis Program Description (TAPD) . Revision B:

We feel that we need a timely written expression of agreement (which could take the form of a letter - a DSER is not necessag) that the relevant items have been satisfactorily addressed, or timely Requests for Additional Information (RAls) on the TAPD Rev. B (Reference 3). Testing preparations are nearing completion at all three

B in close cooperation with the NRC Staff. We would expect the NRC Staff to concur that the issues are fully addressed and that the tests planned are reasonable and acceptable barring any surprises that may come from l the tests. We request you to reevaluate and determine if a written expression of NRC concurrence with TAPD Rev. B could be issued by mid-June 1995.

TAPD Revision C:

TAPD Rev. C is intended to close out the remaining programmatic issues raised in the DSER on the TAPD Rev. A. These relate primarily to the clarification and expansion of the Phenomena Identification and Ranking Tables (PIRT) and completion of global scaling of the test facilities. The TAPD Rev. C will be submitted by the end of August l 1995. GE intends to present this information concurrently to the ACRS Thermal '

Hydraulics Phenomena Subcommittee for their review. We request that you reevaluate and determine if a SER could be issued by the end of October 1995. j I

TRACG Model LTR NED-32176:- l Our understanding is that the TRACG Model Licensing Topical Report (LTR) NED-32176 (submitted in February,1993) review is nearly complete. There have been several rounds of Requests for Additional Information (RAIs) which have been closed for some time. NRC has requested several clarifications and additional detail which has been discussed with the Staff (Reference 5). We request that you consider Usuing a Draft Safety Evaluation Report (DSER) on this LTR mid year 1995 so that we can have a clear appreciation of any remaining NRC concerns. A revision to this LTR will be submitted by the end of 1995; this is ahead of the Reference 2 schedule. This LTR is not dependent on the testing results. We request that you issue a SER by the end of May 1996 (based on 2 months for NRC review and submittal of RAIs to GE,1 month for GE to satisfactorily respond to the RAIs, and 2 months for NRC to issue the Model LTR SER).

TRACG Qualification LTR NED-32177:

Our understanding is that the TRACG Qualification topical report NED-32177 (submitted February 1993) review is also nearly complete. NRC has requested substantial additional information, some of which comes from the Testing part of the Program. We request that you consider issuing a DSER on this LTR by the end of year 1995. A Supplement to this report which has been discussed with the Staff will be submitted April 1996. As indicated in Reference 2 pre-test and preliminary validation calculations are being provided on a timely basis. We request that the review of the Supplement be conducted such that a SER could be issued by mid-September 1996.

' TRACG Application LTR NED-32178: l Our understanding of the TRACG Application topical report NED-32178 (submitted February 1993) review is that it is least complete and most dependent on completion of the testing. and evaluation of calculational uncertainties. It will-_ be revised and resubmitted in April 1996 as indicated in Reference 2.. We have agreed with the Staff to l keep them informed of the testing, the TRACG testing analyses, and the development -

l of the application methodology such that most of the materials included in the April 1996 revision will already have been reviewed. We request that review of the Revision result in an issued SER by mid-September 1996.

As you requested, we have provided a discussion of the actions in response to the PANDA operational readiness review in Reference 4. Those actions required for the PANDA Steady State tests have been completed.

We wish to develop a mutually acceptable schedule, and agree that your timely review-depends in large part on complete and timely submittals by GE. We intend to do this.

The "SBWR Drywell to Wetwell Vacuum Breaker Valve White Paper" Attachment to this letter is the GE response to item No. 42 in Attachment 2 to the Reference 1 letter. The ,

purpose of this paper is to present additional information regarding exemption of the SBWR vacuum breakers from the single failure criteria based on demonstrated reliability..

The paper describes the design features of this special vacuum breaker valve which-significantly improve its leak tightness and reliability performance. The paper also -

presents the rigorous leak tightness, performance, Design Basis Accident (DBA), and reliability testing which the valve has successfully undergone in substantiating this i exemption from the single failure criteria.

In the GE Response to RAI Number 900.63 (Reference 2), a discussion of vacuum breaker actions for analyses, transients and accidents, including a Gravity Driven '

Cooling System (GDCS) line break and discussion of assumptions made for both

. GENuclearEnergy MFN No. 021-95 Page 2 expected and " licensing basis" scenarios was presented. Reference 2 also included detail as to why failure to close (after actuation) of a drywell to wetwell vacuum breaker is not,-

in GE's view, a credible failure.

L lL In the GE Response to RAI Number 900.62 (Reference 3), information was presented to l enable the staff to access the adequacy of the wetwell-to<lrywell vacuum breaker test

, program including: drawings of the vacuum breaker and instrumentation; the vacuum I

breaker Purchase Specifications; a copy of the Engineering Operating Procedure; detailed specification of the conditions, both normal and design basis, under which the vacuum breakers will be required to operate; the detailed test procedures for the vacuum breaker; and information appropriate to ensuring that the data obtained on the reliable performance of the valve is applicable to the valves to be incorporated into the certified plant design.

We hereby request your review of this letter along with the references and approval of -

this request for exemption of the subject vacuum breaker from having to meet the single failure criteria for application to the SBWR.
