NUREG/BR-0025 INFORMATION REPORT ON W,.., State Legis ation OFFICE OF STATE PROGR AMS u.S. NUCLEAR REGULATORY COMMISSION Vol. 9, No. 7 Many State legislatures are either out of session or have had short special sessions during the summer months and as a result, this issue is brief.

On August 3, 1983, the National Governors' Association passed a resolution (D-15) on emergency preparedness at their meeting in Portland, Maine. The resolution adopted by the Governors says that

"... in the absence of a plan meeting minimun Federal standards, the States should take responsibility for preparing a plan. The Federal government should be empowered to develop a plan as a last resort in the event that all other entities fail to develop an acceptable plan." The resolution also says that "the failure of a local government to prepare plans and/or to conduct emergency response exercises" should not be the basis for revoking a license or rejecting an application for one.

The National Conference of State Legislatures met in San Antonio, Texas, August 8-12, 1983. Resolut. ions on low-level and high-level waste were debated and passed.

Senate Judiciary Hearings on the Southeast Low-Levei Radioactive Waste Compact, the latest compact to be submitted to Congress, will be held in South Carolina on September 6,1983.

Included h this issue is the latest status ; hart on legislation introduced and enacted in each of the compact groups.

The Office of Otate Programs will tiost its National State Liaison Officer's (RO) meeting December 6-7, ?983 in the Conmissioner's Conference Room in Washington, DC. Anong quest speakers included are:

Chairman Palladino; William Dircks the Executive Director for Operations; Victor Stello, the Deputy Executive Director for Regional Operations and Generic Requirements; Herzel Plaine, the General Counsel; and several Office Directors. Tcpics of discussion will include a review of regulatory requirements, waste management, emergency preparedness and recent court decisions.

Connecticut Power Plant Decommissioning Funds, S-396. Requires each licensee of a nuclear power plant to submit a decommissioning financing plan for the facility to the Department of Public Utility Control no later than June 1, 1984 The plan will include information on: closure, decommissioning costs, shares attributed to each owner, plans for funding decommissioning, and plans for periodic review of the plan itself.

Describes procedures for hearings and approval of the plan.

Connecticut Northeast Interstate Low-level Radioactive Waste Compact, H-8027.

Enacts the Compact into law and enters the State as a party.

Florida Southeast Interstate low-level Radioactive Waste Compact, H-1149.

Enacts the Compact into law and enters the State as a party. (Enacted 6/24/83.)

l Maine Development Sites, LD-1772,. Provides a practical means by which the State may control the location of major new developments so they have a minimal adverse impact on the environment.

Maine Low-Level Waste Facilities, LD-1738. Places certain requirements on proposed low-level waste disposal and storage facilities; describes environmental, social and economic requirements, municipal participation, judicial review and legislative approval. (Enacted 6/27/83.)

North Carolina Southeast Interstate low-level Radioactive Waste Compact, S-196.

Enacts the Compact into law and enters the State as a party.

Nuclear Emergency Fund, A-3701. Permits municipalities which have a nuclear power plant within their borders to establish a nuclear emergency fund which would provide financial assistance for life support expenses for residents evacuated from their homes as a result of a nuclear accident. The fund would also provide money to reimburse residents for property damage resulting from a nuclear accident.

Describes rules for administration of the fund.

New York Diagnostic X-rays, A-7075. Prohibits hospitals from billing separately for the routine interpretation of diagnostic X-rays. (Introduced:

New York Low-Level Waste Commission, A-7299, S-6839 Establishes an advisory conmission on low-level radioactive waste disposal, consisting of 17 members, to conduct a study and recommend to the governor and i

legislature an appropriate course of action in complying with the Low-Level Radioactive Waste Policy Act of 1980. A draft study would be submitted on or before January 1, 1984.

New York Shoreham Nuclear Power Plant, A-8187. Orders the Long Island Lighting Company to divest itself in any ownership interest in the Nine Mile Point Two Nuclear Power Plant, so that the ratepayers of Long Island can be spared from a sudden large increase in rates due either to the Shoreham or the Nine Mile Point Two Nuclear Power Plant.

Ohio Radioactive Waste H-456 Requires the Power Siting Board to verify the existence of a safe, demonstrated technology for the transportation of nuclear fuel rods, reprocessing of nuclear fuel rods, and disposal of t

spent fuel and other nuclear wastes, before granting a certificate for l

an electric generating plant which is fueled by nuclear fission.

Provides for legislative review of the board's findings.

Requires any persons engaged in uranium mining to pay an occupation tax to the State amounting to one per cent of the gross value of the delivered minerals.
