Dear Chairman Palladino:
At Monday's oral argument, the Commission requested in-formation concerning plants that have received operating li-censes without full compliance with the NRC's regulations as applicable to full power operation.
In addition to the ca.ses cited in LILCO's and the Staff's comments to the Commission and discussed during the oral argument, a number of recent low power licenses have been issued with conditions that suggest less than full compliance with the NRC's full power regula-tions.
A list of examples is attached.
The enclosed information was drawn from the licenses issued to the plants referenced.
The license conditions gener-ally do not cite the particular regulation requiring the condi-tion nor do they describe the background or the condition.
Consequently, the details of the license conditions were not readily available to LILCO.-
Nonetheless, the list does indi-cate that the NRC routinely assesses the need for full compli-ance with regulations written for full power operation in light of the activities authorized by the license.
Whether this analysis was done pursuant to S 50.57(c), an exemption provi-sion, or routine Staff practice for license conditions, it is precisely the type of analysis that was performed for Shoreham by the NRC Staff in approving LILCO's low power proposal.
