On September 28,1983, the Federal Emergency Management Agency (FEMA) published in the Federal Register (48 FR 44322) their final rule 44 CFR 350, " Review and Approval of State and Local Radiological Emergency Plans and Preparedness". Among other changes, this final rule amended the exercise frequency for State and local governments to a biennial requirement.

10 CFR 50, Appendix E, section IV.F.1.a states in part:

A full-scale exercise which tests as much of the licensee, State, and local emergency plans as is reasonably achievable without mandatory public participation shall be conducted; For each site at which one or more power a.

eo As you are aware, the NRC published in the Federal Register on July 31,1983, (48 FR y%

33307) proposed amendments to bring 10 CFR 50, Appendix E, Section IV.F.1.a, into substantial conformance with the FEMA ruling. However, as a result of the current nio schedule for publishing the proposed amendment to 10 CFR 50, Appendix E, we find that our CALVEX 84 exercise (scheduled for September 11, 1984) may not be performed in o<

Miller April 26,1984 i Page 2 Accordingly, as authorized under 10 CFR 50.12 we request exemption from 10 CFR 50, Appendix E, Section IV.F.1.a, as it applies to State and local government participation in an annual frequency exercise. In lieu of this requirement, the State and local government will participate fully in the CALVEX 85 exercise. Pending the timely i implementation of proposed changes to 10 CFR 50, Appendix E, Section IV.F.1.a, we anticipate that this will be a one-time exemption applicable only to the CALVEX 84 exercise. An evaluation by the FEMA Regional Assistance Committee pertaining to State and local government participation in the CALVEX 83 exercise, indicates that all jurisdictions reflected an adequate capability to respond to an offsite emergency for the Calvert Cliffs facility. Based on these results, we have concluded that this request for exemption will not adversely affect the state of emergency preparedness at the Calvert Cliffs facility. FEE DETERMINATION We have determined, pursuant to 10 CFR 170.22, that this request for exemption from specific 10 CFR 50, Appendix E regulations constitute one Class 111 and one Class I-amendment. Accordingly, we are including BG&E Check Number A220988 in the amount of $4,400 to cover the fee for this request.
