APPLICATION FOR CONSTRUCTION PERMIT (TAC NO. M79509)

Dear Dr. Brown:

By letter dated November 13, 1989, as. supplemented, Arkansas Tech University (ATU) applied for a construction permit and facility operating license for a research reactor to be constructed on the AIU campus in Russellville, Arkansas. Subsequently, by letter dated April 10, 1995, you withdrew your request.

l The Commission has filed the enclosed Notice of WiWirawal of Application for Construction Permit and Facility Operating License witn the Office of the Federal Register for publication.

In your letter you committed to inform NRC concerning the disposition of reactor components in your possession when that decision is made.

Please provide this information to NRC at least 30 days prior to the date of disposition.

Please note that the reactor components cannot be assembled without issuance of a construction permit from the NRC. Also note that the reactor components cannot be exported without obtaining the proper license from the NRC.

If you have any questions concerning the withdrawal of your application or disposition of the reactor components in the possession of ATU, please call me at 301-415-1127.
