Gentlemen:

On September 28, 1983, FEMA published in the Federal Register (48 FR 44332) their final rule 44 CFR 350, " Review and Approval of State and Local Radiological Emergency Plans and Preparedness."

The present NRC rule (10 CFR 20, Appendix E) requires annual full participation by state and local governments. In the Commonwealth of Pennsylvania, " full participation" has been determined to be participation by each municipality within the 10-mile EPZ.

l Ten of the 27 municipalities in the BVPS 10-mile EPZ have elected not )

to participate in our 1984 annual exercise. Of the ten non-participating municipalities, three (Aliquippa, Industry, and Midland) have successfully participated in our past two annual exercises. Of the remaining seven, three (Vanport, Ohioville, and Glasgow) are located at the edge of the 5-mile zone, and four (South Heights, South Beaver, Frankfort Springs, and l Chippewa) are located at the outer edge of our 10-mile EPZ. Actual distances and direction from the site for these remaining seven municipalities are listed on the attachment to this letter.

Therefore, pursuant to the provisions of 10 CFR 50.12, Duquesne Light Company respectfully requests an exemption be granted for these ten munici- I palities from the BVPS 1984 annual exercise.
