We represent Thomas J. Saporito, Jr., a former employee at the South Texas Project. We l
are writing concerning the NRC's investigation of Mr. Saporito's harassment and intimidation allegations against liouston Lighting and Power Company ("IIL&P"). The NRC's investigation, l
conducted pursuant to 10 C.F.R. f 50.7, has been pending since March 1992. Moreover, it is our understanding that the investigative reports in that proceeding have long since been completed.

I Saporito's } 50.7 allegations against liL&P will become available for our review, in addition, we would like to know the following: (1) what is the status of that Q 50.7 investigation; and (2) what infonnation has the NRC provided to the licensee concerning the { 50.7 investigation?
The NRC's delay in concluding its s 50.7 proceedings is adversely affecting the prosecution of Mr. Saporito's complaint filed before the U.S. Department of Labor (" DOL") under the federal nuclear whistleblower protection statute (xc,42 U.S.C. { 5851), given the apparent overlap between the { 50.7 allegations and the matters pending before the DOL.
We are concerned that the problem regarding access to infonnation related to the 50.7 investigation is a persistent problem facing whistleblowers whose harassment and intimidation allegations are investigated by the NRC. This bureaucratic delay works to the disadvantage of the whistleblower who is denied access to crucial information by the NRC.
