Dear Administrative Judges:

This refers to the discussion at pages 12-13 of ALAB-753 concerning the use of the word " watertight" in Section 3.4.1 of the FSAR.

The occurrence of seepage due to foundation mat flexural cracks is within the intent of the term " watertight,"

and Licensee agrees with your assumption that any inconsi,stencies arising from the use of that term are semantic and inadvertant.

The basis of the Waterford 3 flood protection design, as required by General Design Criterion 2, 10 C.F.R. Part 50,

floods, tsunami and seiches without loss of capability to perform their safety-related functions."

To implement this criterion, the Nuclear Plant Island Structure is designed to withstand all postulated hydrostatic loadings, and design provisions exist (e.g., waterstops, door seals, waterproofing membranes) to ensure that watar intrusion will be minimized.

The purpose of the " watertight" design feature of the foundation mat is to meet GDC 2, and to minimize seepage to

' avoid overloading the waste treatment system.

The inherent char-acteristics of the foundation mat construction ensure that the amount of seepage water through the existing hairline cracks has been, and is expected to remain, quite small and offers no possi-

bility of interfering with safety-related equipment or overloading the waste water treatment system.

Accordingly, Applicant will submit a clarifying amendment of the FSAR in accordance with the Appeal Board's direction.
