Dear Administrative Judges:
Suffolk County and LILCO have discussed resolution of their differences on the sequence of trial of the Group I issues.
Those differences are reflected in the respective Prehearing Reports of LILCO and the County which were filed on November 22.
The Staff and other parties expressed no preference in the sequence of issues for trial, although the Staff did express the preference to go last on each issue.
LILCO and the County have resolved their differences and recommend that the s'equence set forth in the attachment to this letter be adopted.
I have spoken with Staff and FEMA counsel who have no objection to this proposal.
I add two observations which LILCO counsel requested to be included.
The schedule as attached includes the recognition that some fine tuning, which the parties will endeavor to keep to a minimum, may be necessary to meet-the scheduling conflicts of witnesses whose primary occupations are academic.
It also recognizes that, depending on the disposition of certain pending motions to strike or for discovery, some deferral may be necessary for the testimony of the'Suffolk County school teachers and administrators (Panels 1.2.2 and I.2.3).
In the belief that tomorrow's conference Will be.better focused if the Boa'rd has the benefit of the parties' thoughts in advance, I am having this recommendation delivered this afternoon.
