Docket No. 50-322-OL-3 Gentlemen:
Enclosed are Suffolk County's Proposed Preliminary Findings of Fact and Conclusions of Law relating to Emergency Planning Contentions 23, 25 and 65.
The findings and con-clusions relating to Contention 25 are in one binder; those relating to Contentions 23 and 65 are combined in two binders.
The organization of the findings is set forth in the table of contents in the front of the binders.
The prefix of each finding reflects the contention to which it relates (e.g.,
23:1, 65:2).
The findings relating to the LILCC, FEMA and Staff testimony are preliminary, since, due to time constraints, we have not completed our preparation for cross examination.
In addition, since we were unable to have that testimony re-produced, shipped and received by our consultants until Tuesday, November 22, and the Thanksgiving holiday intervened, these findings do not reflect input from our consultants concerning information we plan to cover in cross examination.
- Finally, although not directly reflected in the findings relating to the LILCO, FEMA and Staff testimony, we plan to cross examine the LILCO, FEMA and Staff witnesses concerning many of the matters addressed in the direct testimony of the Suffolk County wit-nesses, as reflected in the proposed findings on County
&p testimony which are enclosed.
