Docket # 50-42 4-OLA 450-425-OLA ASLBP #90-617-03-OLA GEORGIANS AGAINST NUCLEAR ENERGY Acknowledgement of NRC Staf f and Georgia Power Comments on GANE's Appeal GANE has reviewed the Staff and Licensee comments on our appeal to the Nuclear Regulatory Commission for relief in the matter of the faulty switches on the diesel generators at Nuclear Plant Vogtle. We note with disappointment that both parties avoided discussion of the safety issue and adhered to a narrow discussion of whether our approach to the problem was a proper and conventional way to address the NRC.
One point raised by the Staff and Licensee was the matter of The Brief which '. t is apparent was expected from us. We were uncertain at the point o '. our appeal what the conventions are and therefore had no prior knowledge that a brief would be expected. We think that much has been said at this point and we have nothing further to add. The
" background" and " conclusion" attachments to our appeal clearly stated that: 1) given the probability of reduced NSCW flow and extreme confusion in emergency situations, an operator may very well not have time to perform the function of the safety trip and 2) we recognize that the safety switch is not performing correctly and would pose a danger if left in place so 3) we ask the NRC to exercise their power to remedy the current unsafe situation by requiring that the diesels be made reliable through repair or replacement. Please refer to our appeal dated May 25, 1991 for fuller discussion and let that stand as our "brief."
Comments were made to the effect that we did not attempt to remedy the shortcomings in our contentions. It is our understanding having posed this question to the Safety & Licensing Board that we had run out of process for amending our contentions. We have learned much at this point about the process and the 2.714 rules and would be delighted to i

proffer admissible contentions if the parties wish. However, we are aware that under the 2.714 rules we could only prove that an operator cannot perform the function of the switch, thereby forcing Georgia Power to reinstitute the switch, which would pose an unacceptable hazard. We also think that the information needed to justify corrective action is in the record and writing it into conventional form at this point would only delay resolution of the safety hazard.
We think it is in the best interest of Georgia Power, the NRC and the citizens of South Carolina and Georgia to repair the diesels and lessen the risk of a station b3ackout and the certain risk to life, limb and property that scenario would impose on citizens of South Caro.ina and Georgia. The time is now to move beyond questions of technicalities of process and to find technical remedies to unsafe conditions at a nuclear plant. We ask the Commission to please require Georgia Power to immediately repair sr replace the faulty diesels.
