NOTICE OF RELEVANT DECISION AND SIGNIFICANCE For the Atomic Safety and Licensing Board's ("ASLB")

information, Petitioners submit the attached letter from the l

Supreme Court giving notice of that Court's August 2, 1991 denial [

of Petitioners' Application for a Stay of the possession-only license in the above-captioned proceeding without opinion and ,

without any indication of the presence or absence of a division  ;

v within the Court. ,

As Petitioners advised in the July 30 pre-hearing I conference, in these circumstances there is no need to hold these  !

proceedings in abeyance pending the decision of the U.S. Court of Appeals for the District of Columbia Circuit on the petition for l review of the possession-only license in that Court. July 30, 1991 Prehearing Conference Transcript ("Tr.") at 8. *.

However, this does not diminish the need for the Board  ;

to issue appropriate orders to the Long Island Lighting Company i pursuant to 10 C.F.R. S 51.101(a) to protect the ASLB's jurisdiction to decide whether the proposal to decommission needs to be subject to an environmental impact statement or whether it  ;

should be subject to a finding of no significant impact

("FONSI"). See Petitioners' Amendment and Supplement to Petitions to Intervene at 12-13 (filed July 1, 1991); Tr. at 74-

75. Nor does it affect the jurisdiction of this ASLB, in the -

event that it decides that an EIS on the proposal to decommission  ;

Shoreham is warranted, to issue further orders pursuant to 10 f

C.F.R. SS 51.100(a) & 51.101(a) modifying or vacating NRC Staff f

approvals issued and restraining the NRC Staff from issuing [

t further " approvals," especially any which might adversely affect j l

the Commission's decisionmaking alternatives after consideration of the final EIS. Id.  ;
