SHOREHAM OPPONENTS COALITION'S

" CONFERENCE OF COUNSEL" REPORT Pursuant to the Board's October 13 Order Scheduling Confer-ence of Counsel, SOC submits the following information concerning contentions 21(c) and 93-97.

a. SOC has entered into no stipulations with LILCO.
b. With respect to contention 21(c) SOC does not expect to offer documentary evidence.

With respect to contentions 93-97, SOC intends to offer into evidence (1) copies of back issues of NEWSDAY describing storms and electrical outages that have hit Long Island and their ef fects upon transportation, the provision of public services, etc., and (2) official meteorological records prepared by the Department of Commerce documenting storms that have hit Long Island.

In addition, SOC has received documents in response to discovery requests which may be offerred into evidence.

With respect to contention 21(c), SOC has no plans to offer testimony from witnesses at this time.

With respect to contentions 93-97, SOC will present testimony from Dr. Theodore Goldfarb.

d.

With respect to contention 21(c), the time needed to present our case will depend largely on the case made by LILCO.

In any event, the total should be one day or less.

With respect to contentions 93-97, the time needed to present our case should be approximately one day.

The amount of time needed f or cross-examination cannot be estimated at this point.

No settlements have been entered into with respect to contentions 21(c) and 93-97.

We have no recommendation concerning the order of contentions to be litigated.

g.

It would be helpful to set a deadline for the filing of proposed findings of f act and conclusions of law for the Group II issues.
