l 56 Fed. Reg. 22460 (the " Notice"). The-Notice addressed'an-April 22, 1991 application by Georgia Power Company (the

" Licensee") to amend the operating licenses for the Vogtle 9107150059 910628 ADOCK 0500 4 gDR p 9 L, ._ __ _ . - - _ _ _ _ . _ _ _ _ . . _ _ _ _ _ - . _ _ _ , _ _ _ _ _ _ . _ . _ . _ _

e Electric Generating Plant Units 1 and 2 ("VEGP") by eliminating from the Technical Specifications a diesel generator testing frequency requirement which Generic Letter 84-15 indicates is oxcessive and potentially damaging. Idz at 22468-69.

On June 14, 1991, the Georgians Against Nuclear Energy ("GANE") filed with the NRC a " Petition For Leave To Intervene" concerning Georgia Power's April 22, 1991 application. The petition, however, fails to comply with the minimum requirements applicable to a petition.-

The NRC's Rules of Practice at 10 C.F.R. S 2.714 require that a petition for leave to intervene meet specific pleading requirements, including demonstration of standing.

With the possible exception of the last clause of 10 C.F.R. S 2.714(a)(2), the petition fails to meet these requirements.

The Board should also be mindful that GANE and the particular GANE representative who signed the petition are familiar with the NRC's procedural requirements. GANE is represented by the same individual in another VEGP license amendment proceeding presently pending before the commission.

Therefore, GANE should be held to a high degree of technical ('

compliance with the NRC Rules of Practice.
