With The Commission. The Intervenor rejoins the National  ;

i Whistleblower Center and seeks an order from the Board requiring all parties to submit to the Board a copy of each and every deposition transcribed by a party, i I. DISCUSSION ,

A. Transcribed Depositions Must Be Forwarded to The i Commission The governing regulation 10 C.F.R. S 2.740a(e) provides:

When the testimony is fully transcribed, the deposition shall be submitted to the deponent for examination and signature unless he is ill or cannot be found or refuses to sign. The officer shall certify the

! deposition or, if the deposition is not signed by the deponent, shall certify the reasons for the failure to sign, and shall promptly forward the deposition by registered mail to the Commission.

Intervenor agrees with the National Whistleblower Center's assertion that it is the responsibility of the party who orders a deposition transcribed to promptly arrange to have that deposition forwarded to this Board. In this instance the Board is the entity to whom the depositions should be forwarded. The regulations define Commission as "...any officer to whom has been delegated authority pursuant to section 161n of the Act." 10 C.F.R. S 2 . 4 .1 WHEREFORE, Intervenor respectfully requests that the Board: '

1) grant the National Whistleblower Center's Motion for Leave to Participate by a Non-Party; 2) grant the Center's Motion to Compel Filing of Transcribed Depositions With The Commission; 3) grant Intervenor's motion on rejoinder the National Whistleblower Center's Motion and 4) issue an order requiring the parties to 2

other matters, provided that the Commission issues regulations setting forth the scope, procedure, and l limitation of the authority of such board.

The ASLB is such an advisory board. Sag 10 C.F.R. S 2.721 (Commission's procedure for the establishment of such a licensing board); and S 2.721(c) (provisions concerning the scope and limitation of such a licensing board's authority). Therefore, as defined in 10 C.F.R. S 2.4, the Atomic Safety and Licensing Board would constitute the " Commission" for the purpose of submitting depositions.
