I COMES NOW, The National Whistleblower Center and moves the '

1 Atomic Safety and Licensing Board, pursuant to 10'C.F.R. S' i  ;

2.740a(e) to compel Georgia Power and NRC Staff to file with the l

Commission all depositions pertaining to the diesel' generator phase of the above captioned proceeding that were transcribed upon thier requests. The Center makes this request for the l following reasons.

l I. DISCUSSION The National Whistleblower Center has recieved information.

that Georgia Power Company, NRC Staff and the Intervenor have, in l fact, transcribed several depositions pertaining to the diesel generator phase of this proceeding. Nonetheless, these depositions were not filed with the Commission as required by 10 l

l C.F.R. 5 2.740a(e). This provision requires the party who l transcribes the deposition to "promptly forward the deposition by l 9503160150 950309 i PDR ADOCK 05000424 O PDR C 7 0}-

i registered mail to the Commission." 10 C.F.R. 52.740a(e). The l

depositions in question were ordered apparently in the summer of 1994 but were not filed with the Commission. The Center believes that the parties to this proceeding have violated this regulation j i

and have thereby keep the existence of these transcribed- i depositions secret from the public.

l When enacting the Atomic Energy Act, Congress specifically 1

acknowledged the public's interest in nuclear power and granted i the public the right to intervene and to otherwise have access to and review documents pertaining to a licensing proceeding. To comply with these requirements, the Commission files notice in l l

the Public Register of the institution of a licensing proceeding.

The Commission must also make available.for public inspection documents pertaining to a licensing hearing. The Commission issued 10 C.F.R. S 2.740a(e) so as to require the party who transcribed a deposition to file it with the Commission. NRC I

staff and Georgia Power have transcribed depositions but have failed to file them with the Commission. The filing of a l

t deposition with the Commission would ensure that information l

relevant to the licensing of a nuclear facility was publically l available.

l WHEREFORE, the' National Whistleblower Center requests that l

the Board compel the parties to file all depositions they~have l transcribed with the Atomic Safety and Licensing Board. I i
