This morning Intervenor received your Memorandum and Order

concerning the reopening of Mr. Mosbaugh's deposition.

Order grants Licensee's motion to reopen Mr. Mosbaugh's Deposition without giving Intervenor the opportunity to respond.
The Board expressed the view that Intervenor is unable to file a meaningful response.
Intervenor agrees that he cannot rebut the in camera submission, however, Intervenor believes that he can file a meaningful response to this motion.
In fact, Intervenor i
had already filed a response which was served on March 8, 1995.
