Dear Ms. Hiatt:

This is in further response to your letter dated August 9,1983, in which you requested six categories.of documents relating to probabilistic risk assessment and evacuation time estimates.

The following report entitled, " Review and Evaluation of the GESSAR-II Probabilistic Risk Assessment - Containment Failure Modes and Fission Product Release," prepared by BNL under contract to the U.S. Nuclear Regulatory Comission contains certain portions which the General Electric l

Company (GE) considers confidential business (proprietary) information.

l The NRC has reviewed the material, agrees that it is proprietary, and finds that its disclosure would cause sut;stantial harm to the competitive position of GE.

Release of GE's containment failure information would deprive them of the ability to seek reimbursement of the substantial costs the company has expended while also permitting their competitors i

to utilize this information to their detriment.

Foreign competitors, including competing BWR suppliers, without expenditure of their own resources, could then obtain this containment information at no cost.

This would enable foreign competitors to produce their containments at lower costs than General Electric, resulting in damages to the competitive position of GE.

This information is being withheld from public disclosure pursuant to Exemption (4) of the Freedom of Information Act (5 U.S.C.

552(b)(4)) and 10 CFR 9.5(a)(4) of the Comission's regulations. The nonexempt portions of the report are enclosed.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that'its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

Dear Mr. Felton:

Pursuant to the Freedom of Information Act, 5 USC S 552, as amended, and the provisions of.10 CFR Part 9, the undersigned hereby requests the following:

1.

Any probabilistic risk assessments performed for the Perry Nuclear. Power Plant, either by or for the Cleveland Electric Illuminating Co. or by or for the NRC.

2.

Any systems interactions studies for Perry, again prepared by or for either CEI or the NRC.

y 3.

Any reports concerning the source term for BWR/6 Mark III reactors.

4.

Any evacuation time estimates (other than the one performed by-Alan Voorhees & Assoc. referenced in the Perry PSAR) per-formed for the Perry site, including computer printouts relating

-to any such study.

5.

PNS-I-83-14 and -14A, and all documents concerning same, on possible equipment tampering at the Beaver Valley 1 station.

6.

A~ concise. list of all security infraccions, violations, non-compliances, or preliminary notifications (with short ex-planations and references) involving the Beaver Valley Unit 1~ Power Station.

'I request.that the Commission waive 75% of the fees for the search,and production of items 1-4 above, as these items relate (or may relate, depending on the Applicant's defense) to the emergency planning-issue, Issue #1, admitted in the Perry OL proceeding.

I agree to accept the remaining charges.
