Pursuant-to 10 C.F.R. $ 2.749(a), Georgia Power Company 1
-(" Georgia Power") hereby submits its statement of material facts' i
as to which there is no genuine issue to'be heard:

-In March 1990, Plant Vogtle personnel and an NRC inspector, inspected the diesel generator control air filters and-concluded j
that the filters looked new (e.g., there were no_ rust particles or other evidence of moisture in the control air system).

On April 6, 1990, Mr. Mosbaugh praised Engineering personnel
-for the work they did on the diesels and how well they interfaced with the Incident Investigation Team ("IIT") and that the IIT

By; April'6, 1990, the IIT was informedc of' higher.than; expected dew-point measurements and that preliminary indications were that the high' readings were due to a cad dew point sensor instrument.

On April 6, 1990,. Georgia Power performed an inspection of-the 1A diesel air receiver which was witnessed by an NRC i
inspector.
Neither the. rust nor the oil residue found duringLthe inspection was unusual or of concern to Georgia Power or NRC personnel.
5.
On April 9, 1990, NRC representatives were informed of a.
recent high dew point reading of 60.9'F on the 2A diesel air receiver and that it was attributable to the associated' air dryer being-turned off a few days earlier.
6.
On April 9-10, 1990, the NRC was informed orally and-in writing of historic unacceptable dew' points.

personnel on the morningfof April 11, 1990 there was~a consensus:

In April, 1990, the diesel manufacturer (Cooper) advised Georgia Power personnel that they considered the air quality of I
the Vogtle diesel control air to be acceptable.

Vogtle personnel informed-the NRC that they believed the current 3
air quality of-the diesels to be satisfactory although, during 1988, one of the air dryers was out of service for maintenance.-

i The diesel air quality statements in Georgia Power's April 9,
1990 letter to NRC discussed only the current status of the t
i diesels' instrument air quality and conveyed GPC'sfjudgment that the diesel control air quality relative to moisture or " humidity" -
was satisfactory at that time.

As of April 9, 1990, the NRC was satisfied that the diesel _
f control air quality was acceptable and that the Vogtle' diesel
. generators were operable and reliable.

The August 1990 NRC Operational Safety Inspection concluded that Georgia Power did have an adequate basis to assess the quality of the diesel' starting air syst-on April 9, 1990 and they did not find that Georgia Power misrepresented the diesel air quality in the April 9 letter.

During a 1994 inspection, the NRC Staff concluded that Plant j
i Vogtle' maintenance documentation provided no indication that-water had been detected in the control and protection portion of the system at any time.
The inspectors further concluded that f
water formation in the air system was unlikely because of the i
decrease in dew point associated with the pressure reduction in the control air system.
