GEORGIA POWER COMPANY'S MOTION CONCERNING THE USE OF {

DEPOSITION TESTIMONY AT THE DIESEL STATEMENTS HEARING

. Recently, counsel for Georgia Power Company proposed that i the parties agree on a procedure for using deposition testimony I at the hearing on the diesel generator statements allegation.

(February 22, 1995). The letter explained that there were a number of depositions which have not been transcribed and some i

which were transcribed and provided to the deponent months after the deposition took. place. Georgia Power believes that it would be prudent to avoid the disruption at the hearing of an eleventh hour use of deposition transcripts which the deponents had not had sufficient opportunity to review.

Georgia Power proposed that the transcripts of all deposi-  !

tions which any party intended to use at the hearing be provided

to the deponents for review no later than March 20, 1995.I'

i deposition was taken shall file the transcript with the Board, t and serve copies on the other parties, in accordance with 10 ,

C.F.R. Georgia Power advised the parties that, I

absent an agreement to this procedure, it would seek a ruling to {

this effect from the Board. A reply'to. Georgia Power's letter was. requested no later than February 24, 1995. {

Georgia Power received a response to its letter from the NRC  ;

Staff agreeing to the proposed procedure. Saa letter from >

i Charles Barth to John Lamberski (February 24, 1995). No response has been received from the Intervenor. Accordingly, pursuant to the Board's authority established by 10 C.F.R. S 2.718, Georgia Power hereby moves the Licensing Board to issue a ruling concern-ing the use of deposition testimony at the diesel statements i hearing consistent with the' procedure proposed in Georgia Power's February 22, 1995 letter. i l

the deponent no later than two weeks after the completion of the i deposition.
