It is with serious concern that I write to you concerning a staff 5.Nh.
recer.mendation to the Nuclear Regulatory Cc==ission (NRC) that the Three
~,{
Mile Island Unit 1 facility could be restarted by February 1984.
I am
-- O shocked that the Co= mission would even consider the restart issue with a

Federal trial in progress concerning alleged criminal actions by Metropolitan yj Edison, the outstanding questions concerning the competence of the g
management of General Public Utilities, and the technical, administrative

and critical funding proble=s plaguing the clean up.

I insist thct the NRC take ne action towards a rectart of Three 3~
Mile Island Unit 1 which would in any way interfere with or comprocise 3g the functions of the Federal Courts in determining whether criminal violations of Federal law occurred in connection with the accident of
.' c, 1979.
I would consider any decision by the NRC concerning restart which is taken prior to the conclusion of the criminal trial to be based on i; Q incomplete evidence because the issues presented in the grand jury it&
indictment must be fully litigated and considered by the NRC before any l ;,
restart decision is cade.
It is scarcely believable that a government body could be so in-j.h sensitive to the very real concerns of those individuals =ost affected
- gg by the near-tragedy of TMI.
It is clear that mistakes were made, and
-,,y possible that criminal violations occurred.
Until we resolve these

issues,' restart is simply out of the question.

-, :- j The Governor of Pennsylvania, both Senators and the area Congressmen b y, y are united in opposing any further consideration of activating the undamaged reactor until all the outstanding issues before the Federal Court and the NRC are brought to a convincing conclusion.
